IABCA Terms & Conditions
These Terms & Conditions apply to all programs, initiatives, awards, conferences, forums, roundtables, gala events, receptions, delegations, immersion weeks, cultural experiences, business missions, exhibitions, networking events and related activities organised, managed or facilitated by the India Australia Business & Community Alliance (IABCA) and/or Gandhi Creations Pty Ltd ("IABCA Activities").
1. Entire Agreement
These Terms & Conditions, together with any registration forms, ticketing information, event materials, program documentation and written communications issued by IABCA, constitute the entire agreement between the participant and IABCA in relation to the relevant IABCA Activity.
These Terms & Conditions supersede all prior discussions, negotiations, representations, understandings and agreements, whether written or verbal.
2. Registration & Participation
Participation in any IABCA Activity is subject to registration, availability and compliance with these Terms & Conditions.
IABCA reserves the right to refuse, cancel or revoke participation where deemed necessary and at its sole discretion.
3. Program Changes
IABCA reserves the right to amend, postpone, substitute, reschedule or cancel any speaker, venue, activity, program element, date, schedule or event format where reasonably required.
While every effort will be made to notify participants of significant changes, IABCA shall not be liable for any costs, losses or inconvenience arising from such changes.
4. Ticketing, Transfers & Refunds
Unless otherwise stated in writing, all registrations and ticket purchases are non-refundable.
Participant substitutions or ticket transfers may be permitted at the discretion of IABCA and subject to applicable deadlines and administrative requirements.
IABCA reserves the right to apply administration fees to approved transfer requests.
5. Third-Party Providers
IABCA may engage third-party venues, transport operators, accommodation providers, caterers, tour operators, exhibitors, suppliers and service providers in connection with IABCA Activities.
IABCA accepts no responsibility or liability for the acts, omissions, services, products or conduct of any third-party provider.
6. Participant Responsibilities
Participants are responsible for ensuring they are medically fit to participate in any IABCA Activity and for arranging and maintaining their own travel, health, medical, accident and personal insurance coverage where appropriate.
Participants are responsible for complying with all applicable laws, venue requirements, safety instructions and reasonable directions issued by IABCA or its representatives.
7. Assumption of Risk
Participation in any IABCA Activity is voluntary and undertaken at the participant's own risk.
Participants acknowledge that certain activities may involve travel, transport, public events, conferences, exhibitions, cultural experiences, business missions and other activities beyond the direct control of IABCA.
8. Release & Waiver
To the maximum extent permitted by law, participants release and hold harmless IABCA, Gandhi Creations Pty Ltd, its directors, employees, contractors, volunteers, advisors, ambassadors, jury members, partners and representatives from any claim, liability, loss, damage, injury, cost or expense arising from participation in any IABCA Activity, except where liability cannot be excluded under Australian law.
9. Limitation of Liability
To the maximum extent permitted by law, IABCA and Gandhi Creations Pty Ltd shall not be liable for any indirect, consequential, incidental or special loss, including loss of profits, loss of opportunity, travel expenses, accommodation expenses, business interruption or reputational damage arising from participation in any IABCA Activity.
Any liability that cannot be excluded by law shall be limited to the amount paid by the participant for the relevant IABCA Activity.
10. Photography, Filming & Media Consent
By attending or participating in any IABCA Activity, participants acknowledge and agree that photographs, video recordings, audio recordings and other media content may be captured and used by IABCA and Gandhi Creations Pty Ltd for promotional, marketing, reporting, archival, educational and communication purposes without compensation.
11. Privacy
Personal information collected by IABCA may be used for event administration, stakeholder engagement, communications, reporting and related activities in accordance with applicable Australian privacy laws.
12. Intellectual Property
All IABCA branding, event materials, program content, publications and related intellectual property remain the property of IABCA and/or Gandhi Creations Pty Ltd unless otherwise stated.
13. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Australia and the State of New South Wales.
Participants submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
14. Acceptance
By submitting an application, purchasing a ticket, registering for, attending or participating in any IABCA Activity, participants acknowledge that they have read, understood and agree to be bound by these Terms & Conditions.
